I. Voucher Issuance Service

1. These Terms and Conditions provide information about the functioning of the voucher issuance service on this website of our Partner, Augustine Management s.r.o. (02586312).

What is a voucher?

1. A voucher entitles you to draw benefits in the kind and value specified by the particular issued voucher within the period of its validity. The voucher can only be used once, unless otherwise specified in specific conditions. Specific conditions for use of a particular voucher will be provided by our Partner before conclusion of a contract; alternatively, they are accessible on our Partner’s website.
2. The web interface for ordering of vouchers (the voucher issuance service) is run by us, i.e. the company voucherino s.r.o., headquartered in Rumjancevova 65/20a, Liberec I - Staré Město, 460 01 Liberec, IČO: 067 16 334, registered in the Commercial Register maintained by the Municipal Court in Prague, section C, file no. 287719 (hereinafter “voucherino” or “we”).
3. We run the web interface under a contract concluded with our Partner. In accordance with this contract, we ensure the technical aspect of voucher sale for our Partner, i.e. the issuance, security, and delivery. The activities described below are therefore conducted under the contract with our Partner and under our Partner’s authorization.
4. If you order a voucher via this web interface, a contract for the provision of services specified by the voucher is created between you and our Partner. We are not a contracting party of such a contract. A contract for the provision of services specified by the voucher is subject to Terms and Conditions of our Partner, available here: www.augustine-restaurant.cz.
5. These Terms and Conditions serve as a complement to the Terms and Conditions of our Partner. In the event of a conflict, our Terms and Conditions take precedence over Terms and Conditions of our Partner.

II. Ordering Vouchers

1. This website provides an overview of vouchers currently offered by our Partner. Information provided for individual vouchers, especially information related to validity period, price, and other terms and conditions, are provided by our Partner, who is liable for their correctness. For specific conditions, see Terms and Conditions of our Partner. The offer of vouchers is informative, i.e. in order for a contract to be concluded between you and our Partner, it is necessary that our Partner confirms your order. The provisions of Section 1732 (2) of the Civil Code does not apply.
2. All prices of vouchers are provided including all taxes and fees, excluding delivery costs. If there occurs a price that is evidently wrong and possibly resulting from technical problems, the Partner is not bound by such a price, and a contract between you and the Partner is not concluded.

How to Order

1. Vouchers may be ordered via a form on the web interface run by us. In agreement with us, our Partner can provide also other means of voucher ordering (e.g. via e-mail or telephone).
2. Before submitting the order, please check all data filled in. We shall consider these data correct and complete and shall issue and deliver the ordered voucher in accordance with them.
3. Following the submission of an order, the system automatically generates and sends you an order confirmation.

Payment Terms

1. Vouchers may be paid:
   by a bank transfer;
   via an online payment gateway.
2. In case of payment by a bank transfer, use the order reference number as a variable symbol. The order reference number will be sent to you in the order confirmation.
3. A contract on the voucher purchase is concluded at the moment you receive a binding order confirmation. In case you choose to pay via an online payment gateway and the price is paid prior to receiving a binding order confirmation, the contract is concluded already with the act of paying the price.

III. Delivery of Vouchers

1. Following a proper payment of the price to our account in accordance with the chosen payment method (we are authorised by our Partner to accept payments for him), we will send you a voucher with an assigned QR code. The voucher includes important information related to its validity and the identification of the Partner; and the terms and conditions of its use will either be provided along with it or will be referred to.
2. A voucher will be sent to you in accordance with the chosen form of delivery: via e-mail or mail. You can choose the delivery method within the order form.
3. We will also issue a tax invoice or an equivalent document with the requisites pursuant to valid Czech legislation.
4. The delivery costs of vouchers depend on the prices set by the chosen transport company. The order shall always state the final price including the delivery costs for the chosen means of delivery. If you choose e-mail delivery, the voucher will be delivered in 24 hours.
5. If you choose delivery via the postal service or another transport company, the voucher will be sent in the chosen way in 2 days. The delivery date depends on the transport company.
6. Upon delivery, whether via e-mail, or by postal service or another transport company, please check carefully the content of the voucher.
7. We are entitled to reimbursement of delivery costs in the following events:
    You refuse to take over the voucher without merit;
   It is necessary to deliver the voucher repeatedly or using the means of delivery other than agreed.

IV. Withdrawal, Change of Contract, Complaint

1. You can cancel your order before the contract is concluded, i.e. before either the binding order confirmation is delivered or the price is paid.
2. You can withdraw within 14 days from the delivery of the voucher. If you decide to withdraw from the contract after its conclusion, see conditions for such withdrawal from contract with our Partner in our Partner’s Terms and Conditions. In the event of withdrawal, we shall reimburse the price of the voucher in accordance with the manner of payment you have chosen in the order, unless agreed otherwise.
3. Upon withdrawal from contract, the QR code generated for your voucher will be inactivated; consequently, it will no longer be possible to use the voucher.
4. In the event you need to change the details of the voucher (the name for which it shall be issued, the period of validity, etc.), please contact our Partner. The Partner is not obliged to satisfy such requirements.
5. A complaint about the services that shall be provided in accordance with the voucher must be raised with our Partner, in accordance with the Partner’s Terms and Conditions and with relevant legislation (especially the Act. No. 89/2012 Coll., Civil Code). We are not responsible in any way for the services provided by our Partner.
6. You can raise a complaint with us concerning the functionality of the voucher, i.e. the functionality of the unique QR code generated for you. If the voucher is not usable or contains mistakes in the writing or other mistakes, please contact us at info@voucherino.com. Your complaint will be handled as soon as possible, within 30 days at the latest.
7. In accordance with the Act No. 634/1992 Coll. Sb., on consumer protection, as a consumer, you have the right to an out-of-court settlement of a consumer dispute arising from the contract. In such a case, you are entitled to contact the Czech Trade Inspection Authority, (Central Inspectorate – ADR Department), Štěpánská 15, 120 00 Praha 2, e-mail: adr@coi.cz, web: adr.coi.cz). Out-of-court settlement of a consumer dispute is initiated exclusively at your request, in the event that the dispute has failed to be resolved directly with us. You can submit the application no later than 1 year from the day when you first exercised your right which is the subject of the dispute with us. You are entitled to initiate the out-of-court settlement of a dispute online via the ODR platform available at the website ec.europa.eu/consumers/odr/.
8. In case you are not a consumer but instead you shop at your ID, the possibility of withdrawal from the contract does not apply to you.

V. Personal Data

1. As part of voucher processing, we process your data which you fill in the form or communicate to us. These include mainly: name, surname, e-mail address, delivery address, and bank account number. We process personal data for the purpose of concluding a contract between you and the Partner, delivery of a voucher, and settlement of complaints.
2. We process these personal data for our Partner who is the personal data controller. Personal data are processed in accordance with the Regulation of the European Parliament and of the Council (EU) No. 2016/679, on the protection of natural persons with regard to the processing of personal data, on the free movement of such data, and repealing the Directive 95/46/ES, and only to the extent set by a contract for the personal data processing concluded with our Partner and following the Partner’s instructions.
3. In addition, we process your name, surname, and e-mail address in order to provide you with occasional updates on interesting news, and to offer our services. This procedure is enabled by Section 7 (3) of Act No. 480/2004 Coll., on information society services, unless you reject them. You can reject them at any time via the e-mail gdpr@voucherino.com or by clicking on a link in the e-mail.

VI. A Few Concluding Final Provisions

1. The partner in whose name we issue the voucher based on your order may determine specific conditions for use of the voucher, especially the period of validity, number of uses, transferability to other persons (free-of-charge or charged), age limit, etc. based on the type of service and at the Partner’s discretion.
2. By purchasing the voucher, you confirm that you have read these Terms and Conditions related to delivery of a voucher, with the Partner’s Terms and Conditions, as well as the conditions for using the voucher, and you agree to abide by all of these conditions.
3. All agreements between us and you are governed by the laws of the Czech Republic. If our relationship contains an international element, the relationship shall be governed by the laws of the Czech Republic. This does not affect the consumer`s rights under generally binding legislation.
4. All rights to the web interface on which vouchers are ordered, in particular copyrights to the content, including page layout, graphics, trademarks, logos, and other content and elements, belong to us or the Partner. It is forbidden to copy, modify, or otherwise use the website or any part thereof without our consent.
5. The wording of the Terms and Conditions may be changed or supplemented. This does not affect the rights and obligations arising in the period of validity of a previous version of the Terms and Conditions.

Tento poukaz nelze vyměnit za hotovost a není možné jej kombinovat s jinými slevovými akcemi.

Rezervace Vám bude zpětně potvrzena. Tento poukaz je nutné předložit při příchodu do spa.

Jakékoli změny rezervace je třeba nahlásit nejpozději 24 hodin před potvrzeným termínem, jinak bude voucher považován za vyměněný.
